Milwaukee County Judge Hannah Dugan‘s federal trial is being delayed.
Dugan is charged with concealing an individual to prevent arrest, a misdemeanor, and obstruction, which is a felony. Prosecutors say she escorted Eduardo Flores-Ruiz, 31, and his lawyer out of her courtroom through a back door on April 18 after learning that U.S. Immigration and Customs Enforcement agents were in the courthouse seeking to arrest him for being in the country illegally.
She could face up to six years in prison and a $350,000 fine if convicted on both counts.
Online court records show a judge delayed her trial, which was scheduled to start July 21. There is no new date set at this time, records show.
The federal judge overseeing the case decided to delay the trial, wanting to settle an important matter first: the defense’s motion to dismiss the case entirely.
Dugan’s legal team filed that motion to dismiss the charges, citing judicial immunity and constitutional grounds. They claim the actions Dugan takes as a judge are protected.
An in-person scheduling conference is set for July 9.
