Focus: Postconviction Relief-Ineffective Assistance of Counsel-Sanctions

In his eighth attempt to obtain postconviction relief, Rafeal D. Newson appeals the circuit court’s orders denying his petition for habeas corpus and denying his motion for reconsideration. Newson makes various arguments related to jurisdiction, ineffective assistance of counsel, and the application of State v. Escalona-Naranjo, 185 Wis. 2d 168, 517 N.W.2d 157 (1994) to bar his claims.

The appeals court rejects Newson’s arguments and affirms the orders. Additionally, because Newson continues to abuse the appellate process by repetitively litigating the same matters after having been warned twice against doing so, the appeals court imposes sanctions limiting his ability to submit future appellate filings relative to his

criminal case.

Affirmed.
