Timothy Brown convicted of First Degree Intentional Homicide in Fond du Lac shooting

After a four-day jury trial Timothy D. Brown was convicted of First-Degree Intentional Homicide with a Dangerous Weapon and Felon in Possession of a Firearm, according to Fond du Lac County District Attorney Eric Toney.

The incident occurred August 20, 2022 on Marquette Street in the City and County of Fond du Lac. Brandon Johnson was shot to death by Brown, according to Toney.

Judge Walker revoked bond, ordered a pre-sentence investigation report and the sentencing date has been set for Friday March 17 at 9 a.m.

“Our hearts go out to the family and friends of Brandon Johnson and our sincere gratitude to the jury for their time and attention during this jury trial. We continue to work with law enforcement to aggressively prosecute gun violence in our community and hold violent criminals accountable by taking them off our streets. This was an incredibly well documented investigation by the City of Fond du Lac Police Department and their detective bureau, which was instrumental in securing these convictions,” Toney said.

According to court documents obtained by the Wisconsin Law Journal, investigators executed a search warrant at the defendant’s residence and located clothing matching what the defendant wore on August 20, 2022 and that was observed in the surveillance footage near the shooting. The surveillance reflects the defendant took a different route than what he told investigators and lied about being home the entire night and not having seen or spoken with the victim. The State of Wisconsin Crime Lab matched victim’s DNA to the red stain consistent with blood located on the defendant’s white shoes, which are consistent with shoes worn by the defendant the night of the shooting

The case was prosecuted by District Attorney Eric Toney and ADA Gordon Leech. It was investigated by the City of Fond du Lac Police Department.
