Criminal Procedure — new trials — newly discovered evidence

The State of Wisconsin objects to an order of the circuit court granting Fontaine Washington a new trial on the basis of newly discovered evidence. We affirm the circuit court, though on different grounds. See State v. Smiter, 2011 WI App 15, ¶9, 331 Wis. 2d 431, 793 N.W.2d 920 (WI App 2010) (“[W]e may affirm the circuit court’s order on different grounds.”). Not recommended for publication in the official reports.
