Motor Vehicles – OMVWI – postconviction relief

Michael Mauermann appeals a judgment convicting him of operating a motor vehicle while intoxicated in violation of Wis. Stat. § 346.63(1)(a), second offense, and an order denying his motion for postconviction relief. Mauermann was initially stopped for squealing the tires of a vehicle in violation of Iowa County Ordinance § 600.08, which prohibits certain types of noises, including tire squeals, that are loud and unnecessary and that may tend to annoy or disturb others. He contends that the ordinance is unconstitutionally vague, and therefore that the traffic stop was improper and that evidence arising from the stop should have been suppressed. Affirmed. This opinion will not be published.
