An inspector for Occupational Safety and Health Administration (“OSHA”) attempted to conduct an inspection of Anthony Marano Company, a fruit and vegetable wholesaler in Chicago. AMC’s management considered the timing of this inspection to be suspicious because the company was scheduled to go to trial on another OSHA matter four days later.

Appellants are truck drivers who obtained settlements from their former employer for violations of the Fair Labor Standards Act (FLSA), 29 U.S.C. § 216(b), and Indiana wage laws, IND. CODE § 22-2-5, -9. The truck drivers here contend that the award of attorney’s fees awarded by the district court, should have been higher.
