Focus: Contract-Negligence

Lost Lake Cranberry, Inc. (Lost Lake) sued Iron County for breach of contract and negligence, alleging that the County had an oral agreement to maintain measures preventing snowmobile trail users from trespassing and to compensate Lost Lake for damages. The court ruled that the alleged oral contract did not comply with the statute of frauds, which requires certain contracts to be in writing. Moreover, without the alleged contract, the County owed no duty of care to Lost Lake. Therefore, Lost Lake’s negligence claim also failed.

Affirmed.
