Focus: Postconviction Motion for Resentencing

Randy Keith Scott appeals from a judgment of conviction for one count of second-degree sexual assault of a child and one count of incest, and an order of the circuit court denying his postconviction motion for resentencing without a hearing. The appellate court affirmed the decision on the grounds that Scott’s legal team failed to object during the trial (leading to forfeiture of the argument), the information at sentencing was accurate and acknowledged by Scott, and his guilty plea waived further challenges to these facts. This affirmation upholds the initial ruling without necessitating a resentencing hearing.

Affirmed.
