7th Circuit Court of Appeals

Case Name: Elizabeth Alicea v. County of Cook

Case No.: 22-2863

Officials: Sykes, Chief Judge, and St. Eve and Lee, Circuit Judges.

Focus: Fourth Amendment Privacy Rights

In this matter, the Seventh Circuit scrutinized the constitutionality of Cook County, Illinois’s deployment of cameras to monitor toilets in holding cells within county courthouses. The plaintiffs, individuals awaiting trial, contended that the cameras violated their Fourth Amendment privacy rights and constituted an intrusion upon seclusion under Illinois law. The district court, siding with the defendants – Cook County and Sheriff Thomas J. Dart – granted summary judgment, prompting the plaintiffs to appeal.

The Seventh Circuit ruled that the plaintiffs lacked a reasonable expectation of privacy when using toilets in courthouse holding cells. While acknowledging uncertainties regarding detainees’ privacy expectations in their bodies within a holding cell, the court asserted that such rights are significantly diminished. It further deemed Cook County’s use of cameras in courthouse holding cells as reasonable, given the inherent security risks in that environment. The court also concluded that one plaintiff, Alicea, had standing to sue, while the others did not.

Moreover, the court upheld the district court’s decision to grant summary judgment on the intrusion upon seclusion claim, stating that the plaintiff failed to meet the burden regarding the fourth element of the claim – anguish and suffering.

Finally, the court affirmed the district court’s rulings on discovery and attorneys’ fees, finding no abuse of discretion in these matters. Consequently, the district court’s judgment was upheld.

Affirmed.

Decided 12/18/23
