Caine: Trump disqualified for presidency under 14th Amendment

Virginia Senator Tim Kaine said Sunday there is a strong legal argument to apply the 14th Amendment to remove former President Donald Trump from the ballot in 2024, citing Trump’s actions related to the Jan. 6 attack on the U.S. Capitol, ABC News reported.

“In my view, the attack on the Capitol that day was designed for a particular purpose at a particular moment, and that was to disrupt the peaceful transfer of power of as is laid out in the Constitution,” Kaine said Sunday in an interview with ABC News. “So I think there’s a powerful argument to be made,” the Virginia Senator noted.

“The language is specific,” Kaine said, referring to language in the amendment that Trump “engaged in insurrection or rebellion against the same, or [gave] aid or comfort to the enemies thereof,” despite taking an oath to uphold the constitution.

Previously, a Trump campaign spokesman said use of the 14th Amendment is “blatant election interference,” noting that Trump has not been charged with insurrection.

Ultimately it will be up to the Supreme Court to decide.

“The court distributed John Castro v. Donald Trump to the justices for conference on Wednesday ahead of the upcoming term, which will begin on October 2, Newsweek reported. Conference is to take place on September 26 and the case is expected to be decided on or before October 9.
