7th Circuit Court of Appeals

Case Name: Michael Leisgang v. Kilolo Kijakazi

Case No.: 22-1970

Officials: Scudder, St. Eve, and Lee, Circuit Judges.

Focus: Social Security Benefits

Leisgang, who suffers from various mental health conditions, applied for supplemental security income and disability insurance benefits. The Administrative Law Judge (ALJ) determined that Leisgang’s limitations prevented him from performing his past work but sought assistance from a vocational expert to determine if he could perform other available jobs. The vocational expert identified several job options based on outdated job titles and relied on the equal distribution method for estimating job numbers. Leisgang did not raise any concerns about the methodology during the hearing. The district court and Seventh Circuit affirmed the denial of benefits, stating that Leisgang forfeited his argument by not objecting during the hearing, and substantial evidence supported the ALJ’s determination.

Affirmed.

Decided 06/26/23
