Man pleads no contest to amended charge in death of boy, 4

SHEBOYGAN, Wis. (AP) — A man has pleaded no contest to an amended charge in the death of his fiancee’s 4-year-old son last year in Sheboygan County.

Sheboygan Press Media reported Tuesday that 32-year-old Armando Aguirre of Cascade pleaded no contest to second-degree reckless injury. He was initially charged with second-degree reckless homicide, but it was amended with approval from a judge Tuesday.

According to a criminal complaint, Aguirre in April swung his fiancee’s son and told investigators the child’s head hit a carpeted floor rug with a “glancing blow.”

District Attorney Joe DeCecco says the prosecution plans to recommend Aguirre receive five years in prison and three years’ extended supervision. Sentencing is scheduled for April 7.
