New prison guard union sues over recertification

MADISON, Wis. (AP) – The new union representing Wisconsin prison guards and security workers has filed a lawsuit to avoid taking a second certification vote within a year.

The Wisconsin Employment Relations Commission is requiring the new union to hold another election in November to recertify.

The Wisconsin Association for Correctional Law Enforcement, or WACLE, in July became the union representing about 5,900 state security and public safety employees who once belonged to the Wisconsin State Employees Union.

The State Journal says WACLE contends in its lawsuit that the commission is wrong in requiring a recertification election within a year of the union’s first one. It also alleges the commission is illegally requiring recertification with a vote of 51 percent by all eligible voters, instead of 51 percent of votes cast by bargaining unit members.
