WEST ALLIS, Wis. (AP) – A Wisconsin prosecutor has cleared West Allis police of any wrongdoing in the death of a man who died the day after police punched him and used a Taser on him.

Milwaukee County District Attorney John Chisholm determined police did not use excessive force when they tried to subdue 46-year-old Robert Maurina.

Hospital workers were trying to take a blood sample from Maurina for alcohol testing after a drunken driving arrest last November. After Maurina pulled his arm away, a police officer struck him in the abdomen, but he continued to resist. The officer then used a Taser on Maurina.

The next day, Maurina’s brother found him dead in a basement restroom. The Milwaukee Journal Sentinel reports the medical examiner ruled Maurina’s death natural, due to heart disease.
