Wis. release repeal doesn’t mean new sentence

MADISON, Wis. (AP) – A state appeals court says a prisoner doesn’t deserve to have his sentence revisited because Republicans erased Wisconsin’s early release program.

The program allowed well-behaved inmates to move onto extended supervision sooner. Republican lawmakers repealed it last year.

Milwaukee County Circuit Judge Daniel Konkol sentenced Michael Carroll to 10 years in 2010 on a gun charge.

The sentence is set to begin in 2015.

He argues his sentence should be modified. He says the GOP repeal robs him of a chance to get out early.

But the 1st District Court of Appeals ruled Tuesday Konkol mentioned during sentencing he didn’t want Carroll out early. The court added Carroll doesn’t know if he could even earn early release if the program still existed.

Carroll’s attorney didn’t immediately return a message.
