Family — child support – maintenance — modification

Leslie Helmen appeals an order denying her motion to modify child support and maintenance. Leslie argues the court erroneously exercised its discretion by disregarding certain sources of Kevin Helmen’s income when determining whether there had been a substantial change in circumstances for child support purposes. We agree with Leslie that there was a substantial change in circumstances as a matter of law. Further, we conclude the court erroneously exercised its discretion regarding maintenance. We therefore reverse and remand for the court to properly exercise its discretion to review child support and maintenance. This opinion will not be published.
