MILWAUKEE (AP) — A man who lives in a Milwaukee scrap yard has been charged with killing a 16-year-old who was stealing parts.
David Helton is charged with first-degree reckless homicide. According to a criminal complaint filed Friday, the 53-year-old said he heard noise outside his trailer at H & R Scrap Metals and went out with his shotgun at about 9:10 p.m. Monday. He says he tripped and the gun fired.
Police later found Shelton Smith with a shot in his neck.
According to the complaint, Smith, two other boys and an uncle of the youths climbed over a fence and tossed motors over.
Attorney Steve Kohn said Helton plans to plead not guilty because his conduct was not criminal. Cash bond was set Saturday for $250,000. A preliminary hearing is May 17.
