WEST BEND, Wis. (AP) — The district attorney says an 8-year-old West Bend boy won’t face criminal charges in a fatal house fire.
District Attorney Mark Bensen tells the Daily News that since the boy is under 10, he’s too young to be charged with a delinquent act.
Instead, Bensen said his department likely will file a petition that could result in the boy being placed outside his home.
Police had requested charges after investigating a March 12 fire that killed 29-year-old April Ward.
According to a police report, the boy said he became upset with Ward because she wouldn’t wake up to give him his medication, so he took a lighter from her purse and began to burn her belongings.
Family members told police the boy has been caught starting fires in the past.
