2006AP1418 Stayart v. Hance

Listen to this article

Where a client contacted an attorney with an office in Wisconsin, Wisconsin courts have personal jurisdiction over the client in a breach of contract action brought by the attorney.

“We conclude that the long-arm statute extends to Hance. Hance solicited Stayart’s representation. For the next three years, Stayart performed legal services in this state on Hance’s behalf and with his knowledge and authorization pursuant to the parties’ written agreement. Hance may not now use due process to avoid obligations he voluntarily assumed, especially since the realities of modern commercial life ease the burden of defending himself. See Burger King, 471 U.S. at 474.”

Reversed and Remanded.

District II, Walworth County, Gibbs, J., Nettesheim, J.

Attorneys: For Appellant: Stayart, Gregory, pro se; For Respondent: Murphy, John Michael, Elkhorn; Cunningham, C.E. Bud, Morristown, TN
