The State appeals from a trial court order granting David A. Porth, Sr.’s motion for a new trial based upon ineffective assistance of counsel. The State argues that Porth was not denied effective assistance of counsel because trial counsel’s performance was neither deficient nor prejudicial.

We affirm the order of the trial court.
