Town wins appeal on sign lawsuit

CARY, N.C. (AP) – A federal appeals court has says the town of Cary did not violate a man’s First Amendment rights when it fined him for a sign painted on his house.

The News & Observer of Raleigh reported that the 4th U.S. Circuit Court of Appeals in Richmond, Va., overturned a lower court decision in favor of the estate of the late David Bowden.

Cary fined Bowden after he painted the words “Screwed By The Town of Cary” on his house in 2009.

Judge Albert Diaz wrote that those upset with Cary’s sign ordinance should turn to the ballot box, rather than the courts, to resolve their grievance.

Bowden painted the sign to complain about a town construction project he thinks damaged his former home. The town denied the claim.
