This is just one of several instances where Jaconi has undertaken representation of clients only to subsequently fail to prepare for the trial properly or to act with reasonable diligence in representing the client and has repeatedly attempted to refund unearned fees with bad checks.

Accordingly, because of the seriousness of Jaconi’s behavior, we accept the referee’s recommendation that Jaconi’s license to practice law be suspended for one year, and that he be ordered to make restitution to the persons stipulated.

So Ordered.
