Ineffective assistance

The State appeals from an order granting David Scott a new trial on the ground that Scott was denied the effective assistance of trial counsel when convicted of three counts of sexual assault of a child under age thirteen. We agree with the trial court’s determination that deficiencies in the performance of Scott’s trial attorneys prejudiced Scott and entitle him to a new trial. We affirm the trial court’s order.  This opinion will not be published.
