WI Court of Appeals – District II

Case Name: State of Wisconsin v. Jacinto S. Rico

Case No.: 2015AP507

Officials: Neubauer, C.J., Reilly, P.J., and Gundrum, J.

Jacinto Rico appeals pro se from a circuit court order denying his WIS. STAT. § 974.06 (2015-16)  motion alleging ineffective assistance of trial counsel arising from a failure to request jury instructions relating to defense of others and accident. We conclude that the circuit court did not err in declining to hold an evidentiary hearing on Rico’s postconviction motion. Rico also argues that his convictions should be reversed because there was an error in the self-defense jury instruction. We see no error. We affirm the order denying Rico’s postconviction motion
