Insurance — breach of contract — summary judgment

Eagle Fuel Cells-ETC, Inc., appeals an order granting summary judgment to its insurer, Acuity, a Mutual Insurance Company. The circuit court determined Eagle’s breach of contract and bad faith claims against Acuity were time barred. It also determined Eagle had failed to make the preliminary showing of bad faith required to survive a motion for summary judgment. We agree, and therefore affirm. This opinion will not be published.
