A Republican prosecutor asked the Wisconsin Supreme Court on Tuesday to decide whether a 174-year-old state law bans abortion in the state without waiting for a ruling from a lower appellate court.

A conservative prosecutor is asking a judge to toss out Democratic Attorney General Josh Kaul's lawsuit challenging Wisconsin's 173-year-old ban on abortions, arguing that it lacks legal merit and that there is no weight to assertions that it is unenforceable because of its age.

Wisconsin Attorney General Josh Kaul said Monday that he wants his lawsuit challenging the state's 173-year-old abortion ban to move quickly through the courts, but it could be months before anything happens after defense attorneys signaled they would try to dismiss it next year.
