MADISON, Wis. (AP) — A criminal complaint filed in Dane County says a teenage driver told police he was “kinda wasted” when he crashed a car into the back of a parked semi, killing his friend.

Donovan Luz-Torres, 19, is charged with homicide by drunken driving and driving without a valid license causing death.

The complaint said Luz-Torres had a blood alcohol content of 0.17%, more than twice the legal limit to drive, according to the State Journal.

Eighteen-year-old Justin Wixom, of Fitchburg, was killed in the crash early Sunday.

Luz-Torres appeared by video from the Dane County Jail for an initial court appearance Wednesday. Dane County Court Commissioner Mario White set his bail at $1,500. Luz-Torres’ lawyer, Chris Van Wagner, said it is likely bond would be posted by the defendant’s family.
