High court to decide on discipline for Milwaukee attorney

The Wisconsin Supreme Court will be deciding whether to publicly reprimand a Milwaukee lawyer over four allegations of misconduct.

The Office of Lawyer Regulation filed a complaint in July against Diann Burton, alleging, among other things, that she had practiced law in 2016 while her license had been suspended for failing to pay dues, hadn’t told her clients about the license suspension and had identified herself as working for a law firm even though she was a solo practitioner.

The OLR is asking the Wisconsin Supreme Court to publicly reprimand Burton, which would not bar her from practicing but make any decision issued in her disciplinary case public.

Burton never responded to the OLR’s complaint, and the OLR filed a motion in November asking the referee in the case, Kim Peterson, to find Burton in default, adopt the allegations in the complaint as being true and recommend that the high court publicly reprimand Burton.

In a report filed on Dec. 26, Peterson granted the OLR’s motion and recommended that the justices publicly reprimand Burton. Next, the Wisconsin Supreme Court will review Peterson’s report and issue a final decision in the matter.
