Eau Claire officer won’t face discipline for fatal shooting

EAU CLAIRE, Wis. (AP) — Eau Claire’s police chief says an officer will not be disciplined for fatally shooting a man last year.

Chief Gerald Staniszewski said Tuesday that the Eau Claire Police Department’s administrative review found Sgt. Jesse Henning followed the department’s policies and procedures.

Authorities say Eau Claire resident Michael Caponigro fired a shotgun at law officers who were checking on his welfare after he made “homicidal and suicidal” comments in a domestic violence incident on July 22, 2017. Henning fired back, killing Caponigro.

Earlier this year the district attorney cleared Henning , saying the shooting was a justified use of lethal force. Henning returned to regular duty shortly after that decision, after being on administrative assignment.

The Police Department’s administrative review also found all officers involved in the case complied with policy.
