Hearing set in ex-Fond du Lac attorney’s reinstatement bid

A former Fond du Lac attorney who requested that his license be revoked will be making a case for getting it back.

In 2010, the Wisconsin Supreme Court accepted Christopher Mutschler’s petition asking for his license to be revoked, noting that if the Office of Lawyer Regulation would formally charge him, there could be “scores or even hundreds of counts of misconduct.”

Mutschler contended that he could not defend himself against the OLR’s allegations, which included that he had committed possibly hundreds of counts of misconduct while representing dozens of clients in traffic, drunken driving and criminal cases.

The OLR had conducted 59 investigations stemming from grievances from Mutschler’s clients. The OLR alleged that Mutschler would take advanced fees from clients, advise them to take a no-contest plea and promise he would win their case on appeal but would not tell them they would have to appear in court. In some cases, Mutschler was alleged to have failed to appear in court as well.

Moreover, Mutschler had been caught forging prescription forms and using them to get prescription pain medication. He was charged in 2007 in Dodge County with two felony counts of forgery and one count of possessing and illegally obtaining a prescription. The prosecutor had deferred prosecution on the forgery count and later dismissed it.

In December, Mutschler filed a petition for reinstatement. A hearing before the referee in the case, Jonathan Goodman, is set for 9 a.m. July 12 at Brown & Jones Reporting, 735 N. Water St., Milwaukee.

After Goodman makes a recommendation as to whether Mutschler should be reinstated, the Wisconsin Supreme Court will review that recommendation and issue a final decision in the matter.
