Ozaukee County attorney fighting misconduct allegations

A Mequon solo-practitioner is denying lawyer-regulators’ allegations that he broke lawyer-ethics rules primarily while representing a woman from Madison in a foreclosure case in Ozaukee County.

The Office of Lawyer Regulation filed a complaint last year alleging that Carl Scholz broke 10 lawyer-ethics rules. The OLR’s allegations stated that Scholz disbursed more than $60,000 from his trust account without a court order, spent it on matters not related to the client’s case, lied to the client’s former attorney and submitted fabricated documents to the court in order to hide the fact that he had spent money he was supposed to be holding in trust.

The OLR is asking not only that the Wisconsin Supreme Court suspend Scholz’s license for two years but also that the justices order him to return more than $60,000 and either pay it to the Ozaukee County circuit court or deposit it into his opposing counsel’s trust account.

Scholz responded to the OLR’s complaint on Friday, denying that he had broken all 10 ethics rules and asking the court to dismiss the entire complaint. Scholz also stated in the filing that no discipline should be imposed if the matter goes to a hearing. In the event he is found to have violated any rules, Scholz is arguing that whatever disciplinary measures are taken should not involve a suspension of his law license.

The court-appointed referee in the case, Kim Peterson, will make findings of fact, conclusions of law and recommend any disciplinary measures. The high court will then review those findings and conclusions and issue a final decision in the matter.
