KENOSHA, Wis. (AP) — A man whose conviction for killing his former wife was overturned on appeal is once again on trial in Kenosha County.
Fifty-three-year-old Oscar Thomas was convicted 10 years ago of first-degree intentional homicide, sexual assault and false imprisonment. He was sentenced to life in prison with no possibility of parole. Thomas argued he accidentally strangled Joyce Oliver-Thomas during consensual sex in December 2006.
The Kenosha News says a federal appeals court overturned Thomas’ conviction, ruling his attorney was ineffective and failed to consult with an expert who could have refuted testimony from the medical examiner.
The couple was divorced, but continued to live together with their two sons in Kenosha.
