OLR wants Milwaukee attorney to pay more than $7K

The Office of Lawyer Regulation is recommending that a lawyer who failed to respond to dozens of allegations of misconduct pay the full cost of his disciplinary proceeding.

The recommendation stems from proceedings that began when the OLR filed a complaint last year, originally charging Sergio Magaña with 27 counts of misconduct, including fabricating letters from the U.S. State Department and lying to clients about having done work on their cases. The OLR amended the complaint in December, adding 47 more alleged rule violations, including allegations that Magaña had failed to notify the agency and the Supreme Court Clerk that he had been convicted of a second drunken-driving offense.

Magaña failed to respond to the OLR’s complaint, and the OLR filed a motion in April calling for him to be found in default.

Magaña also failed to attend a hearing on the motion held in May. The court-appointed referee, Jonathan Goodman, filed a report in June finding Magaña in default and recommended that the Wisconsin Supreme Court revoke Magana’s license.

Goodman also recommended that Magaña pay the cost of the proceeding and $1,070 in restitution.

The OLR reported July 14 that the cost of the proceeding is $4,925.31, which includes $360.53 in referee’s fees, $4,525.78 in attorney fees and disbursements and $39 for process of service.

Goodman will review the costs and issue a recommendation as to whether the court should accept it.

The Wisconsin Supreme Court will then review Goodman’s recommendations and issue a final disciplinary order.
