Portage attorney admits to misconduct but will challenge proposed license suspension

A Portage attorney charged with misconduct including punching and pointing a gun at someone is challenging the license suspension that has requested by the state lawyer-regulation agency.

According to a partial stipulation filed on March 29, Steven Sarbacker has admitted to the facts that gave rise to the misconduct charges that the Office of Lawyer Regulation filed against him in a Jan. 21 complaint. However, he does not agree with the level of discipline the OLR is asking for.

The misconduct includes failing to turn over money owed to a client from the garnishment of a third party’s wages, punching and pointing a shotgun at a man – which resulted in three criminal misdemeanor charges – and failing to draw up and have a client sign a required written fee agreement.

The OLR is asking the Wisconsin Supreme Court to suspend Sarbacker’s license for 60 days.

Both the OLR and Sarbacker are asking the referee in the case, James Boll, to accept the partial stipulation and schedule either a hearing or briefing on the sanction, according to court filings.
