High court to hear arguments in 5 cases this week

The Wisconsin Supreme Court is set to hear oral arguments in five cases.

The cases are from Iowa, Milwaukee, Racine and Waukesha counties, according to a news release.

The justices will hear oral arguments at 9:45 a.m. Monday in Singh vs. Kemper and at 10:45 a.m. Monday in State v. Gayton.

In Singh vs. Kemper, a criminal case, the court will examine how positive adjustment time can be retroactively applied to a prison sentence. State vs. Gayton, also a criminal case, involves whether a sentencing court can consider a defendant’s status as an undocumented immigrant in determining a sentence.

At 9:45 a.m. Wednesday, the high court will hear oral arguments in Marks v. Houston Casualty Co. At 10:45 a.m. the court will hear Water Well Solutions Service Group Inc. v. Consolidated Insurance Co., and at 1:30 p.m. Wednesday the court will hear Lands’ End Inc. v City of Dodgeville.

In Marks v. Houston Casualty Co., an insurance case, the justices will examine how breach of duty to defend is evaluated and whether the Court of Appeals may have reshaped its precedent in this area of law.

Water Well Solutions Service Group Inc. v. Consolidated Insurance Co. is a case stemming from a dispute over insurance coverage for problems with a municipal well in Waukesha.

Lands’ End Inc. v. City of Dodgeville stems from a dispute between Lands’ End and Dodgeville over the property tax assessment of Lands’ End’s headquarters in the city.

The justices are expected to resolve the conflict between a state statute and the Court of Appeals’ decision in Johnson V. Cintas Corp.

All oral arguments will be held in the Supreme Court Hearing Room, 231 East, in the state Capitol in Madison.
