BARABOO, Wis. (AP) — A Baraboo woman has been sentenced to five years in prison in the fatal stabbing of her brother.

The Baraboo News Republic reports 59-year-old Anne Simon pleaded guilty and was sentenced Monday. An intentional homicide charge against Simon was amended to a reduced count of homicide by negligent handling of a dangerous weapon.

Simon called 911 on Dec. 22, 2014, to report her brother, 56-year-old Donald Simon, was dead at her home. She told investigators that she stabbed him nine hours earlier when he attacked her after an altercation over cigarettes.

Sauk County District Attorney Kevin Calkins said the plea agreement was recognition that Simon could have reasonably convinced a jury she stabbed her brother in self-defense. Defense attorney Craig Mastantuono said he has never concluded Simon “intentionally caused” her brother’s death.
