Opening statements expected in Lake Geneva abuse case

ELKHORN, Wis. (AP) — Opening statements are expected Monday in the trial of a Lake Geneva couple accused of abusing their six children.

The Janesville Gazette reports Kathleen and Martin O’Brien are accused of making the children stand shoeless outside in the winter, picking up a child by the neck and spraying the children with pepper spray. Some kids were adopted from foreign countries.

The couple was charged in May 2012 but the case was delayed pending an appeal to the Wisconsin Supreme Court on a hearsay argument.

It was the center of a debate over whether courts should rely on hearsay evidence to find probable cause at preliminary hearings.

Ultimately, the state Supreme Court let hearsay remain at preliminary hearings.
