Motion for new trial in double homicide denied

OCONTO, Wis. (AP) — A Shawano man convicted of killing his ex-girlfriend and her brother will not get a new trial.

Daniel Schmidt’s post-conviction motion contended an Oconto County judge incorrectly excluded testimony from a child psychologist to help evaluate an account by a minor witness. WLUK-TV reports Judge Michael Judge ruled Monday the defense did not establish the relevance of the testimony.

Schmidt is serving two consecutive life terms with no chance of parole for the May 2009 deaths of Kimberly Rose and Leonard Marsh. They were found fatally shot at Rose’s home southwest of Gillett.

Prosecutors say Schmidt killed Rose to prevent her from disrupting his marriage and to keep her from revealing his marijuana growing operation.
