Grand jury to hear ricin possession case

GREEN BAY, Wis. (AP) — A federal grand jury will hear the case against a University of Wisconsin-Oshkosh student accused of attempting to make the deadly toxin ricin.

The case will be forwarded to the grand jury now that Magistrate Judge James Sickel found probable cause exists that Kyle Smith knowingly possessed ricin. Jurors will decide whether an indictment will be returned and the 21-year-old student will be prosecuted.

Smith was arrested Oct. 31 when Oshkosh police cordoned off the neighborhood around his off-campus house and executed a search warrant after receiving a tip from the university. The FBI sent some white powder found in Smith’s home to the Homeland Security lab at Fort Detrick in Maryland.

Oshkosh Northwestern Media reports the substance tested positive for ricin.
