Judge denies boy’s re-sentencing appeals

SHEBOYGAN, Wis. (AP) — A Sheboygan judge has denied appeals to re-sentence a teenage boy serving a life sentence for killing his great-grandmother two years ago.

An attorney for 15-year-old Antonio Barbeau argued that the life sentence is unconstitutional when applied to a minor. But Judge Timothy Van Akkeren rejected that argument.

Barbeau pleaded no contest to first-degree intentional homicide in the September 2012 death of 78-year-old Barbara Olson. Olson was struck with a hatchet and a hammer in her Sheboygan Falls home. Another boy, Nathan Paape, was convicted as an accomplice and also sentenced to life in prison.

Both boys were 13 at the time of the attack. Barbeau won’t be eligible for release until he’s 50. Sheboygan Press Media reports his attorney plans to go to the state Court of Appeals.
