KENOSHA, Wis. (AP) — A Kenosha couple is suing the woman charged in the death of their baby and the caregiver screening website they used to hire her.

Nathan and Reggan Koopmeiners say Care.com did not perform the background check they paid for when they hired Sarah Gumm in 2012. The couple claims in its wrongful death lawsuit that the company failed to reveal that Gumm had twice been cited for drunken driving and had a battery conviction.

WISN-TV reports that, according to the lawsuit, Gumm was under the influence of alcohol when she caused a head injury to 3-month-old Rylan Koopmeiners that caused the child’s death at her home in Waukegan, Ill.

Care.com says it cannot comment on pending litigation. Gumm has pleaded not guilty to the first-degree murder and aggravated battery in Lake County, Ill.
