GREEN BAY, Wis. (AP) — A Door County man has entered a plea deal after winning a new trial in the hit-and-run death of a man in a wheelchair.

Forty-two-year-old Mark Sperber of Forestville opted Monday not to fight the charge in exchange for a sentence recommendation.

Press-Gazette Media reports Sperber entered an Alford/no contest plea in Brown County to hit-and-run resulting in death. The plea means Sperber does not admit guilt but acknowledges enough evidence likely exists to convict.

Prosecutors agreed to recommend no more prison time than what Sperber already served after being sentenced in 2012 to 10 years in prison. Sentencing is scheduled Friday.

Sperber was driving a company truck when prosecutors say he collided with the wheelchair of 20-year-old John Kennedy in 2011. Sperber claimed he thought he had hit a garbage can.
