State Supreme Court to hear feces cases

The state Supreme Court announced Friday that it has accepted two cases for review which both deal with whether excrement is considered a “pollutant” when it is a component of farm fertilizer.

The cases, Preisler v. Kuettel’s Septic Serv., and Wilson Mutual Ins. Co. v. Robert Falk and Jane Falk, deal with insurance law and whether it is covered under standard policy pollution exclusions. A news release from the court system states that the justices will try to determine whether there’s a difference between cow manure and human feces when either is blamed for contaminating nearby well water.

The cases elicited differing opinions from the Court of Appeals. They are not consolidated.

The court also announced Friday that it has denied review of 51 cases.
