Sexually Violent Persons — discharge hearings

Scott Maher appeals an order denying his petition for discharge from civil commitment as a sexually violent person under Wis.

Stat. ch. 980 (2011-12) without holding a discharge hearing. Maher argues that the circuit court’s denial of his petition without holding a discharge hearing was based on an impermissible weighing of the relative persuasiveness of conflicting examination reports of experts. We agree, and accordingly reverse. Not recommended for publication in the official reports.
