Sentencing – modification — new factors

Derek J. Haines appeals from a judgment of conviction and an order denying his motion to modify sentence. He contends that his statutory ineligibility for the Substance Abuse Program is a new factor warranting sentencing modification. We disagree with Haines and affirm the judgment and order. This opinion will not be published.
