Criminal Procedure – deficient representation – motion for mistrial

Timothy A. Jago appeals the judgment entered on a jury verdict convicting him of four counts of first-degree sexual assault with the use of a dangerous weapon and one count of false imprisonment. He also appeals the trial court’s order denying his motion for postconviction relief. Jago contends that: (1) his trial lawyer gave him constitutionally deficient representation; (2) the trial court erroneously exercised its discretion when it denied his motion asking for a mistrial; and (3) the real controversy was not fully tried. We affirm. Publication in the official reports is not recommended.
