Criminal Procedure – resentencing — vindictiveness

Anthony Popke appeals a judgment of conviction and an order denying his motion for postconviction relief. On appeal, Popke argues that the circuit court erroneously exercised its discretion in denying his motion for resentencing. For the reasons set forth below, we affirm the judgment and order of the circuit court. This opinion will not be published.
