State’s high court to take on 5 new cases

The state Supreme Court announced Friday that it will hear oral arguments for five cases.

According to a news release from the Wisconsin Courts system, those cases include:

  • Legue v. City of Racine, where the justices are expected to address address if and how police officers or firefighters are negligent when they don’t follow traffic signals during an emergency.
  • State v. Bokenyi, which examines whether a prosecutor breached a plea agreement by undermining a sentencing recommendation at the hearing, and whether a defense attorney was wrong for not objecting to the supposed breach.
  • State v. Spaeth, which will address whether a petition to involuntarily commit a sexually violent person may specify an offense that is not the same offense for which the person is being detained.
  • Jackson v. Wis. Co. Mut. Ins. Corp., which will deal with an uninsured motorist case that deals with an incident at the General Mitchell Airport where a Milwuakee County Sheriff’s deputy was hit by a car while on duty. The Supreme Court will address the meaning of the word “use” under the insurance policy.
  • State v. O’Brien and State v. Butts, which both present constitutional challenges to a new law that states hearsay evidence can be introduced and used at a preliminary hearing.

The court also denied review for 85 petitions.
