Court says gender identity disorder not relevant

MADISON, Wis. (AP) – A Wisconsin appeals court says a man in prison for sexually assaulting his cousins is not entitled to a shorter sentence because he has been diagnosed with gender identity disorder.

The 3rd Circuit Court of Appeals issued the ruling Friday in the case of a 26-year-old Green Bay man who pleaded no contest to one count of sexual assault of a child and one count of second degree sexual assault of another child in 2010.

The man was sentenced to four years in prison and five years’ probation.

He appealed, arguing in part that his prison sentence should be reduced to two years and six months years in prison because his gender identity disorder diagnosis wasn’t properly considered.

But the appeals court says that diagnosis was not highly relevant.
