RACINE, Wis. (AP) – A special prosecutor is trying to reopen a homicide case against a man earlier declared incompetent to stand trial in Rock County.
The motion filed in circuit court asked that Keith Abbott be re-examined to determine if he is now competent to stand trial in the 2011 death of Kristin Miller. The motion was filed after Racine County Circuit Judge Tim Boyle ruled Abbott was competent for trial in that county on child pornography charges.
Abbott was accused of fatally stabbing Miller, the mother of his grandson, in January 2011. Her snow-covered body was found wrapped in plastic in a rural ditch in Rock County.
The Journal Times says a judge in February 2012 declared Abbott was incompetent to stand trial on homicide charges. No date has been set for a competency hearing in Rock County.
